Terms & Conditions

You must be at least 18 years of age and have the legal capacity to enter into binding agreements.

By using the Platform, you warrant that:

a. all information provided by you is accurate and current;

b. you have any licences, permits, qualifications, approvals and work rights required to undertake any work promoted through your Profile Listing; and

c. your use of the Platform complies with all applicable laws.

You must provide accurate and complete information when creating an Account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account.

You must promptly update your Account information if it becomes inaccurate or outdated.

You must not allow another person to use your Account.

You may create and maintain a Profile Listing on the Platform.

You warrant that all information contained in your Profile Listing is accurate, current and not misleading.

You are solely responsible for the content of your Profile Listing, including any representations regarding your experience, qualifications, credits, skills, availability or professional background.

We may remove, suspend or refuse to publish any Profile Listing at our discretion.

If you create, manage or maintain a Profile Listing on behalf of another person, you warrant that:

a. you have that person's authority to create, manage and maintain the Profile Listing;

b. you have obtained all consents necessary to upload and publish their personal information, photographs, showreels, professional credits and other Content on the Platform;

c. the information contained in the Profile Listing is accurate and current to the best of your knowledge; and

d. you will provide evidence of that authority upon request by us.

We may suspend, remove or refuse to publish a Profile Listing where we reasonably believe the person creating or managing the Profile Listing does not have the authority of the individual featured in that Profile Listing.

Fees for Profile Listings and Subscriptions are displayed on the Platform.

Unless otherwise stated, all fees are inclusive of GST.

By purchasing a Subscription, you authorise us to charge the applicable fees using your nominated payment method.

Subscriptions automatically renew unless cancelled before the commencement of the next billing period.

All fees are non-refundable and non-transferable.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

We may suspend, remove or deactivate a Profile Listing where fees remain unpaid.

We reserve the right to vary Subscription fees upon reasonable notice.

You may cancel your Subscription at any time through your Account or by contacting us.

Cancellation will take effect at the end of the current billing period unless otherwise stated.

Upon cancellation or termination of a Subscription, we may remove, archive or deactivate your Profile Listing and Content.

A request to remove a Profile Listing does not entitle you to a refund of fees already paid.

The Platform is a directory and networking service only.

We do not guarantee that any user will obtain employment, engagements, auditions, contracts, bookings, representation, income or any other opportunity through the Platform.

Payment of Subscription fees only provides access to Platform features and does not guarantee any particular outcome.

We do not guarantee the visibility, ranking, prominence, exposure or performance of any Profile Listing.

Search results, recommendations and profile placement may be determined by factors selected by us and may change from time to time without notice.

We do not warrant the accuracy, completeness, currency or reliability of any Profile Listing, user information or communication made through the Platform.

Users are responsible for conducting their own enquiries and due diligence before entering into any arrangement with another user.

You retain ownership of all Content uploaded by you to the Platform and all Intellectual Property Rights subsisting in that Content.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, publish, display, distribute and otherwise use your Content for the purpose of operating, maintaining, improving and promoting the Platform.

You warrant that:

a. you own or control all Intellectual Property Rights necessary to upload the Content;

b. the Content does not infringe the Intellectual Property Rights of any third party;

c. the Content is lawful and not misleading; and

d. the Content does not contain material that is defamatory, offensive or otherwise inappropriate.

We may remove, edit, restrict access to or refuse to publish any Content at our discretion.

All Intellectual Property Rights in the Platform, including its software, design, branding, logos, functionality and content, remain our property or the property of our licensors.

You authorise us to use your Profile Listing, name, photographs, showreels, professional credits and other Intellectual Property for marketing, promotional and advertising purposes relating to the Platform.

You must not:

a. upload false, inaccurate or misleading information;

b. infringe any intellectual property rights;

c. impersonate another person;

d. upload unlawful, defamatory, offensive or inappropriate content;

e. harass, abuse, threaten or discriminate against any person;

f. use the Platform for any unlawful purpose; or

g. initiate unjustified, fraudulent or abusive chargebacks, payment reversals or payment disputes.

We may suspend or terminate an Account and recover reasonable costs incurred as a result of any fraudulent or abusive chargeback activity.

The Platform may provide communication tools that allow users to communicate with other users.

Users are solely responsible for any communications they send, receive or participate in through the Platform.

We do not endorse, verify or approve any communication, representation, statement, offer or request made by any user.

We are not responsible for the content, accuracy, legality or conduct of users in connection with any communication conducted through or arising from the Platform.

Users must not use any communication feature of the Platform to:

a. harass, threaten, intimidate or abuse another person;

b. send spam or unsolicited commercial communications;

c. engage in discriminatory, offensive or unlawful conduct;

d. publish or transmit defamatory, misleading or deceptive material;

e. impersonate another person; or

f. solicit or encourage unlawful conduct.

We may monitor, review, restrict or remove communications at our discretion but are under no obligation to do so.

Users may report inappropriate communications to us.

We may investigate complaints and suspend or terminate Accounts where we reasonably believe a user has breached these Terms.

Users should not disclose confidential, sensitive or personal information through the Platform unless they are satisfied that it is appropriate to do so.

We do not guarantee the security, confidentiality or delivery of communications between users.

We are not responsible for any use, misuse or disclosure of contact information exchanged between users.

The Platform acts solely as a technology service connecting industry participants.

We are not an employer, recruitment agency, labour hire provider, talent agency, manager or representative of any user.

Any engagement, employment, contract, arrangement, discussion, negotiation, audition, booking or other interaction entered into as a result of contact made through the Platform is solely between the relevant parties.

We are not responsible for any discussions, negotiations, agreements, engagements, payments, auditions, bookings, workplace conduct, disputes or other dealings between users.

You are responsible for your own taxation, superannuation, insurance and legal compliance obligations.

Your use of the Platform is also governed by our Privacy Policy.

You consent to the collection, use and disclosure of your personal information in accordance with the Privacy Policy.

You consent to receiving service-related notices and communications electronically.

We may suspend, restrict or terminate your Account or Profile Listing where:

a. you breach these Terms;

b. we reasonably suspect unlawful, fraudulent or misleading conduct;

c. your conduct creates legal, reputational or security risks; or

d. continued access may adversely affect the Platform or its users.

Termination does not affect any accrued rights or obligations.

You indemnify and hold harmless us and our officers, employees, contractors and representatives against any loss, damage, liability, claim, cost or expense arising from:

a. your Profile Listing;

b. your Intellectual Property;

c. your communications with other users;

d. your breach of these Terms; or

e. your breach of any law or third-party rights.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law.

The Platform is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not warrant that:

a. the Platform will be uninterrupted, secure or error-free;

b. defects will be corrected;

c. the Platform will always be available; or

d. information stored on the Platform will be preserved or recoverable.

Users are responsible for maintaining their own backup copies of all content uploaded to the Platform.

We do not guarantee permanent storage of content or recovery of deleted content.

To the maximum extent permitted by law, we exclude all liability for indirect, consequential, incidental or special loss or damage.

Our total liability arising from or in connection with these Terms is limited to the total fees paid by you during the 12 months immediately preceding the event giving rise to the claim.

You acknowledge that you have relied on your own enquiries, investigations and judgment in deciding to use the Platform.

You acknowledge that no representation, statement, promise, warranty or guarantee not expressly contained in these Terms has been relied upon by you.

We may amend these Terms from time to time by publishing updated Terms on the Platform.

Continued use of the Platform following publication of amended Terms constitutes acceptance of those amendments.

These Terms constitute the entire agreement between you and us regarding your use of the Platform.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver of any right under these Terms will be effective unless made in writing.

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the exclusive jurisdiction of the courts of Victoria.
